Capital One Must Release Third-party Report on Breach, Judge Rules

A judge has poured cold water on Capital One’s argument that a cybersecurity firm’s forensic report regarding the company’s 2019 data breach was confidential. So reports CyberScoop.

capital oneU.S. Magistrate Judge John Anderson ruled that Capital One must hand over the report, prepared by Mandiant, to lawyers suing the company on behalf of customers.

The ruling could set a precedent for plaintiffs to have more evidence at their disposal in future cybersecurity class actions.
